How to Participate:
1. Participants need to give correct answers to all questions asked throughout the month Of March 2023.
2. Participants need to Follow GainPerk on Instagram https://www.instagram.com/GainPerk/ .
3. Participants need to give answers in comments and tag at least 5 friends/family in comments.
4. The contest ends at midnight 00:01 hrs on 31st March 2023.
5. One can only participate through Instagram.
I. Selection of Winners and Gratification:
- The contest is hosted by GainPerk and will be advertised on the Instagram handle of GainPerk https://www.instagram.com/GainPerk/ .
- There will be a committee formed by the Management of GainPerk. that will choose the winner/s based on the participant’s answers, tags, and the number of likes on the comment. GainPerk will have complete & sole discretion with respect to the choice of the winners.
II. Terms and Conditions:
1. All Participants should be at least 18 years of age.
2. By participating in this contest, a participant unconditionally and irrevocably accepts and agrees to be bound by all the terms and conditions stated herein. This contest is subject to the laws of India.
4. GainPerk may in its absolute discretion curtail or extend the duration period of the said contest, as it deems necessary without any prior notice & liability whatsoever.
5. It is also clarified that any entry, which is found to be obscene, offending, and hurtful, shall be rejected immediately; and appropriate action will be taken against the said participant.
6 A person can participate in the contest as many times as possible during the duration of the contest however can win and claim the prize only once.
7. The decision of the organizer shall be final, and the participants shall accept the decision as a binding one and shall in no event challenge the same.
9. Data collected from participants will only be used by the company for advertising and to improve the user experience and will not be disclosed or shared with any third party other than the Government, if required.
III. Redemption:
1. The winners will be declared by GainPerk on Instagram. The winner(s) will have to provide his/her contact details (email ID, contact number, delivery address) to the GainPerk social media handle/email ID within 3 days from the date of finalization of the lucky draw of the aforesaid contest. In the event of the winner failing to respond, GainPerk will deem this event as a lapse in participation and shall be at liberty to forfeit the prize in its entirety or at its sole discretion, and offer the prize to the next winner at its sole discretion. The technical/manual records maintained with the organizer would be considered final for this purpose. Any failure to send these details to the satisfaction of the organizers at the provided email ID shall result in a lapse of participation in the contest.
2. Award of prizes is subject to verification by the GainPerk team. The organizers reserve the right to request the winners to provide proof of identity. Identification is considered suitable for verification at the discretion of the organizers.
3. The prize includes 1 Gold coin weighing 1 gram for the lucky winner and 10 consolation prizes worth Rs.1000 each to 10 different winners.
IV. Other Terms and Conditions:
1. At the organizers’ request, winners must participate in all promotional activities (such as publicity and photography) surrounding the winning of the prize, free of charge. He/she consents to the organizers for using their name, likeness, image and/or voice in the event of the winners (including photograph, film and/or recording of the same) in promotional material or in any media for an unlimited period without remuneration for the purpose of promoting this programme (including any outcome, and promoting any products manufactured, distributed and/or supplied by the organizers. GainPerk reserves the right to use the shared images for marketing purposes online, offline, and on-ground.
2. The prize under this contest cannot be transferred/exchanged under any circumstances. No cash payment in lieu of the prizes would be made.
3. The organizers reserve the right to change/modify/or withdraw the contest without any prior notice of the same at its sole discretion. The organizers reserve the right to modify the terms and conditions without any prior notice. The decision of the organizer and the auditors will be final and binding with regard to the program and prizes and no correspondence will be entertained in this regard.
4. All decisions pertaining to the contest taken by GainPerk shall be final and binding on the participants.
5. You are providing your information to enter into this promotion and not to Facebook, Twitter, Instagram, or any other social networking site or Gmail/Dropbox. The information you provide will be used as stated in the Terms and Conditions.
6. Participation in this contest shall always be subject to any other terms and conditions that Facebook, Twitter, and Instagram may prescribe.
7. This contest is being created as a promotional activity brought to you by the organizers and all goodwill, copyright, moral rights, or other intellectual rights associated there shall vest exclusively with the organizer.
8. Organizer assumes no liability or responsibility for:
(i) Any errors, omissions, or inaccuracies of content or submissions,
(ii) Personal injury or property damage of any nature resulting from your access to, your exposure to or your participation in the contest.
(iii) Any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information that may be contained therein.
(iv) Any deletion of data or interruption or discontinuance of transmission to or from or through the contest
(v) Failure to win/achieve/register any record attempt.
9. Organizer shall not be liable for any loss of prize due to any incorrect information provided by the winner.
10. This contest shall be subject to the prevailing statutory laws of India. Any dispute arising out of this contest shall be subject to the exclusive jurisdiction of courts in Ahmedabad.
11. The program is subject to force majeure conditions.
12. By participating in this program, the participant agrees to accept the terms and conditions of this program in totality.
13. This contest is independent of other contests run by GainPerk and cannot be combined with any other offer or contest of GainPerk.
14. GainPerk will not be responsible for lost, misdirected or delayed entries.
15. GainPerk reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this offer with or without prior notice due to reasons outside its control.
16. To the extent permitted by law, GainPerk excludes all warranties and representations (whether express or implied) and its liability (including without limitation for negligence) regarding the winnings.
17. That any dispute or difference whatsoever arising out of relating to said contest shall be settled by arbitration by a sole arbitrator appointed by GainPerk. The arbitration shall be in accordance with the Arbitration and conciliation Act 1996. It is mutually agreed the venue of Arbitration shall be in Ahmedabad alone.
18. Employees of the Company and members of the immediate family of any such persons are not eligible to participate and win.
